From Trademark Law to Public Health Governance: Intellectual Property, International Treaties, and the Rule of Law in a Changing Global Order

This conversation brings together recent scholarship examining the evolving relationship between intellectual property, international treaties, trade, public health, development, and global governance.

The discussion will explore how international intellectual property law should respond when treaty commitments, domestic priorities, economic development, technological change, and public health objectives do not point in the same direction.

Among the broader questions to be considered are the relationship between international treaty obligations and domestic regulatory autonomy; the role of intellectual property institutions in shaping access, development, and public welfare; the interaction between trademark law, trade law, and health governance; and the implications of these tensions for the rule of law in a changing global order.

The conversation will be chaired and moderated by Paolo Davide Farah, Chair of the ESIL Interest Group on European and International Rule of Law, who will also serve as discussant. Edward Kwakwa, Assistant Director General of the World Intellectual Property Organization (WIPO), will participate as discussant.
